Overwater Terms of Service

1. Purpose
These Terms govern the conditions for using Overwater (the "App"), and define the rights, obligations, and responsibilities of the operator and users.
2. Definitions
- App: refers collectively to the Overwater mobile application and the onsoonlabs.com/overwater web pages.
- User: an individual who agrees to these Terms and uses the App.
3. Effect and changes
- These Terms are posted in the in-app menu and on onsoonlabs.com/overwater, and take effect on the effective date shown at the top of this document. A version posted before that date is advance notice and does not take effect on its own.
- The operator may revise these Terms when required by applicable law or service operations. Changes are announced at least 7 days before the effective date (30 days for material changes such as added collection items or changes in purpose of use).
- Continued use of the App after a change takes effect is treated as acceptance of the revised Terms.
4. Service use
- Overwater is a personal daily app that turns local weather into a single suggestion for what to do today.
- The App can be used anonymously without sign-up. Core features such as weather, lifestyle advice, quick tasks, the light meter, and Wiki work without an account.
- Children under 14 may use the App anonymously. The App has no in-app purchases and no subscription purchase flow.
5. User responsibilities
- Weather-based lifestyle advice and AI-generated text shown in the App are general reference. Actual outcomes depend on each environment.
- Final safety decisions for plants, household members (pets, children), and the user's own health rest with the user.
- When official sources (forestry service, agricultural extension) provide guidance, please defer to them.
- Users must not use the App in violation of these Terms or applicable law.
Restrictions on AI voice and generation features
Overwater's read-aloud voice is not recorded by a person; it is a synthetic voice generated on your device by AI, and some guidance text in plant Wiki entries is also AI-generated. Users may not use these voice or generation features, or their output (the generated voice or text), to:
- violate any applicable law or regulation;
- exploit or harm minors in any way;
- generate or disseminate verifiably false information intended to harm others;
- generate or disseminate personal information that could be used to harm an individual;
- defame, disparage, or harass others;
- impersonate others or create deepfakes without their consent;
- distribute AI-generated voice or content without clearly disclosing that it is machine-generated;
- make fully automated decisions that affect an individual's legal rights or obligations;
- discriminate against or harm individuals or groups based on social behavior, personal characteristics, or legally protected characteristics;
- exploit the vulnerabilities of a specific group to cause harm;
- provide medical advice or interpret medical results;
- assess or predict individuals in the administration of justice, law enforcement, immigration, or asylum processes.
These restrictions follow the usage terms of the on-device model used for the read-aloud voice (Supertonic-3 by Supertone, Inc., under the BigScience Open RAIL-M License). The same restrictions and the BigScience Open RAIL-M License terms also apply if the bundled model itself, or any copy extracted from the app, is used or redistributed separately. The full license text is available in the app's "Open Source & Data Sources" screen.
6. Limits of service
- Overwater is solo-operated. Server maintenance, third-party API changes, and device conditions may cause temporary feature outages.
- Core data is stored locally on the device first to minimize loss, but permanent retention is not guaranteed. Users are responsible for backing up important information.
- The operator is not liable for damages arising from temporary interruption, change, or termination of free services.
7. Fees
- Every feature of Overwater is provided free of charge. No feature, including AI-generated plant Wiki entries, carries a fee.
- The App has no paid products or subscriptions for sale and no payment or purchase-restoration screens, so there are no renewal, cancellation, or refund procedures.
- Any mobile data charges incurred while using the App follow the plan of the user's own carrier.
8. Privacy
The collection, use, sharing, and deletion of personal information are governed by the separate Privacy Policy.
9. Complaints and dispute resolution
- For rights infringement, inappropriate content, or technical issues, please contact support@onsoonlabs.com.
- Disputes related to these Terms are resolved under Korean law.
- The court of competent jurisdiction for the operator's domicile shall be the court of first instance.
10. Disclaimer
- The App does not guarantee the accuracy of external data (weather, plant information, AI-generated text, etc.).
- Within the scope permitted by applicable law, the operator is not liable for outcomes resulting from decisions a user makes based on App guidance.

Below is the revision record of this document prior to its effective date. The Overwater Plus paid subscription that appears in earlier rows was never actually sold (no product was ever registered with the stores), and from v1.5 the app is entirely free.
